Terms of Use – SmartWind

These Terms of Use govern the use of the SmartWind app. By using the app, you confirm that you have read and agree with all terms below.

1. Nature of the service

SmartWind is an auxiliary sailing navigation tool. It does not replace:

  • Mandatory nautical equipment;
  • Official nautical charts;
  • Certified onboard instruments;
  • Seamanship knowledge, formal training, or navigation rules;
  • Safety standards required by maritime authorities (e.g., NORMAM-03).

The app provides estimates and supporting calculations and must not be used as the sole source for decisions. The user remains fully responsible for complying with all applicable laws and regulations.

2. Responsible use

The user acknowledges that:

  • Smartphone sensors may produce errors due to magnetic interference, hardware limitations, weather conditions, or weak GPS signal.
  • Displayed information is complementary and may include inaccuracies.
  • Safe navigation is the sole responsibility of the vessel operator.
  • The app must be used with good judgment, constant attention, and support from official instruments.

3. Required permissions

The app depends on the following permissions to operate properly:

Precise location (GPS)

Required to calculate speed, route, and heading.

Device sensors (magnetometer, accelerometer, gyroscope)

Used to determine magnetic heading, orientation, and heel angle.

Local storage

Used to save offline segments before sending them to the server.

Internet

Required for data synchronization and dashboard access. Without these permissions, the app will not work correctly.

4. License of use

The user receives a personal, limited, non-exclusive, and revocable license. It is prohibited to:

  • Copy or redistribute the application;
  • Modify or attempt reverse engineering of the software;
  • Use the app for commercial purposes without authorization;
  • Access internal areas, private APIs, or servers without permission.

5. Disclaimer of liability

The SmartWind team is not responsible for:

  • Damages resulting from use or inability to use the app;
  • Navigation decisions made based on displayed data;
  • Smartphone sensor failures or signal loss;
  • Negligence, lack of skill, or misuse of the app by the user.

6. Updates

The application may undergo updates, maintenance, or functionality changes without prior notice. Temporary unavailability may occur during these processes.

7. Account termination and data deletion

The user may request account termination and permanent deletion of all associated data at any time by contacting us via email and following the confirmation instructions sent by the SmartWind team.
